Requesting a Sewer Diversion

The first stage as a private developer or builder is to request the diversion take place. The developer can request a sewer connection contractor such as ourselves to do this for them or apply directly through Yorkshire water themselves. As a developer or private builder, the need for sewer diversion is common and often due to a public sewer preventing the development of land or a property.

The builder or developer may request the diversion under section 185 of the water industry act 1991. Through this act they may either request the sewer be diverted or altered altogether.

Section 185 of the act places the responsibility on Yorkshire Water to 'divert the apparatus in land as necessary' in order to enable the developer to carry out the proposed development work. This duty however does not apply when the sewer is located under or over a public street.

Any diversion of a public sewer under section 195 can be a lengthy process as many parties are involved, this includes developers, consultants, contractors and project managers, all of whom need to be aware of the technicalities involved. Because of this, it is recommended the developer hire an experienced company such as ourselves to take care of the legalities. However, The project developer or builder should account for the diversion process when estimating project timelines.

Once the application for the diversion has been submitted, Yorkshire Water will assess and respond, letting the developer know whether or not the proposal has been accepted.
 

Agreement and Construction

For public sewer diversions to go ahead, there must be an S815 agreement with Yorkshire water in place. Once in place, construction may go ahead.
